{"id":2193,"date":"2021-09-09T15:46:23","date_gmt":"2021-09-09T15:46:23","guid":{"rendered":"https:\/\/toffolettodeluca.it\/\/aree-di-attivita\/consulenza-legale\/whistleblowing\/"},"modified":"2024-09-05T10:11:24","modified_gmt":"2024-09-05T10:11:24","slug":"whistleblowing-investigazioni-azienda","status":"publish","type":"page","link":"https:\/\/toffolettodeluca.it\/en\/consulenza-diritto-lavoro-sindacale\/whistleblowing-investigazioni-azienda\/","title":{"rendered":"Whistleblowing"},"content":{"rendered":"<div class=\"gb-container gb-container-b15d79e9\"><div class=\"gb-inside-container\">\n\n<p>The <a href=\"https:\/\/toffolettodeluca.it\/\/en\/approvata-in-via-definitiva-la-legge-sul-whistleblowing\/\">law<\/a> containing the \u201cProvisions for the protection of the authors of reports of crimes or violations of which they have become aware in the context of a public or private employment relationship\u201d, the so-called <strong>Whistleblowing Act,<\/strong> came into force on 29 December 2017. <\/p>\n\n\n\n<h2 class=\"gb-headline gb-headline-32e3bb32 gb-headline-text\">Entry into force of the <em>Whistleblowing Act<\/em><\/h2>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:100%\"><\/div>\n<\/div>\n\n\n\n<p>For public companies, these measures consist in additions and changes to procedures and safeguards already codified in the legal system, while for private companies the law requires to <strong>adapt organisation and management models referred to in Legislative Decree 231\/2001<\/strong> to prescriptions and tools, including IT, aimed at encouraging and supporting \u201cvirtuous reporting\u201d:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>first and foremost, one or more channels, of which at least one of IT nature, which allow employees to report, by way of accurate and detailed facts, any illegal conduct of which they may have become aware in the discharge of their professional duties;<\/li>\n\n\n\n<li>guarantee of confidentiality concerning the identity of the whistleblower in managing the report;<\/li>\n\n\n\n<li>prohibition of retaliation or discrimination, whether direct or indirect, against the whistleblower for reasons related to the report;<\/li>\n\n\n\n<li>last but not least, disciplinary sanctions for those who violate the measures to protect the whistleblower, as well as for those who wilfully or negligently make reports that are demonstrably unfounded.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"gb-headline gb-headline-08ba84f3 gb-headline-text\">Our service<\/h2>\n\n\n\n<p>Toffoletto De Luca Tamajo offers you a twofold support in order to: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>be in compliance with new legislative provisions;<\/li>\n\n\n\n<li>enjoy the advantages of transparent and virtuous management, minimising organisational costs.<\/li>\n<\/ul>\n\n\n\n<p>Our consultancy aims to analyse any models and solutions already in place by effect of company policies and then implement the most appropriate solution for each individual company, on the basis of a predefined model.
