{"id":5030,"date":"2022-05-12T16:08:27","date_gmt":"2022-05-12T16:08:27","guid":{"rendered":"https:\/\/toffolettodeluca.it\/\/homepage-fullpage-js\/prodotti\/company-policies-pursuant-to-art-4\/"},"modified":"2022-05-30T12:29:42","modified_gmt":"2022-05-30T12:29:42","slug":"policies-art-4","status":"publish","type":"page","link":"https:\/\/toffolettodeluca.it\/en\/studio-diritto-del-lavoro\/prodotti-aree-attivita\/policies-art-4\/","title":{"rendered":"Company Policies (pursuant to Art. 4)"},"content":{"rendered":"<div class=\"gb-container gb-container-b161e4e5\"><div class=\"gb-inside-container\">\n\n<h2 class=\"gb-headline gb-headline-f86225dc gb-headline-text\">Following <em>the reform of Art. 4 of the Workers\u2019 Charter, it is essential to have internal regulations on work tools and company systems, as well as on any data stored on them, in order not to endanger the business and management of the company. <\/em><\/h2>\n\n\n\n<h2 class=\"gb-headline gb-headline-33698915 gb-headline-text\">Reform of the Workers\u2019 Charter &#8211; Art. 4<\/h2>\n\n\n\n<p>As a result of the <strong>reform of Article 4 of the Workers\u2019 Charter<\/strong>, work tools (personal computers, tablets, smartphones, etc.) are excluded from the obligation to reach a trade union agreement or, alternatively, to obtain administrative authorisations. This provision applies even in the case their use is related to the monitoring of workers\u2019 activities remotely. For company safety, asset protection or work organisation tools and systems, however, the need for a prior trade union agreement, or the appropriate administrative authorisation still applies.<br>However, it is not always easy to distinguish the former from the latter. However, it is certain that we need to pay close attention to the issue.<\/p>\n\n\n\n<p>For the employer\u2019s use of any data deriving from all the tools, it is necessary to draw up a <strong>company policy on the tools and systems <\/strong>(whether work-related or not), and <strong>evaluate its relationship with <a href=\"https:\/\/toffolettodeluca.it\/\/en\/studio-diritto-del-lavoro\/prodotti-aree-attivita\/privacy-gdpr\/\">privacy<\/a><\/strong> matters (regulations and policies).
