{"id":10056,"date":"2025-07-14T09:11:48","date_gmt":"2025-07-14T09:11:48","guid":{"rendered":"https:\/\/toffolettodeluca.it\/?p=10056"},"modified":"2025-07-14T14:22:54","modified_gmt":"2025-07-14T14:22:54","slug":"heatwave-2025-guidelines-workplace-safety","status":"publish","type":"post","link":"https:\/\/toffolettodeluca.it\/en\/heatwave-2025-guidelines-workplace-safety\/","title":{"rendered":"Heat Emergency 2025: the new guidelines for safety at work"},"content":{"rendered":"\n<p>The <strong>heat wave<\/strong> currently affecting Italy is causing <strong>high-risk<\/strong> conditions for workers&#8217; <strong>health and safety<\/strong>, especially in sectors involving prolonged exposure to the sun and physical exertion.<\/p>\n\n\n\n<p>In this regard, on 2 July, the Ministry of Labour and the social partners signed a new <strong>Protocol<\/strong> for the <strong>management<\/strong> of <strong>climate-related risks<\/strong> in the workplace, with the aim of continuing production activity while <strong>guaranteeing<\/strong> health and safety conditions in both outdoor and indoor workplaces.<\/p>\n\n\n\n<p>Of a non-binding nature but of strong political-institutional value, this document promotes the adoption of <strong>good practices<\/strong> in order to prevent occupational accidents and diseases as well as discomfort related to workers&#8217; exposure to high temperatures. In particular, it reiterates the obligation of employers, as part of <strong>risk assessment<\/strong>, to also take into account exposure to microclimate and solar radiation, and to put in place the preventive measures necessary for minimising these risks.<\/p>\n\n\n\n<p>Furthermore, it promotes the activation of national, territorial or company <strong>contractual agreements<\/strong> to translate the Protocol into specific measures for each sector.<\/p>\n\n\n\n<p>To this end, specific <strong>information and training on climate-related risks<\/strong>, <strong>health oversight<\/strong>, the adequate <strong>supply<\/strong> of PPE and clothing according to the season, and the <strong>reorganisation<\/strong> of shifts and <strong>working hours<\/strong> are identified as possible areas of intervention.<\/p>\n\n\n\n<p><strong>Reward<\/strong> criteria, recognised by INAIL in relation to occupational health and safety incentive instruments, may be envisaged for companies that adopt agreements implementing the Protocol.<\/p>\n\n\n\n<p>Finally, the Ministry of Labour is requested to formally acknowledge the Protocol with a commitment to support its effectiveness by adopting all the necessary measures to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>guarantee appropriate protection for workers, including the <strong>automatic recourse to social shock absorbers<\/strong> by providing, as an exception to the ordinary rules, the deduction of the relevant periods from the maximum duration limits of redundancy pay;<\/li>\n\n\n\n<li>reorganise <strong>working hours<\/strong>;<\/li>\n\n\n\n<li>provide companies with <strong>protection against<\/strong> all possible <strong>liabilities<\/strong>, such as, for example, those related to late delivery of work.<\/li>\n<\/ul>\n\n\n\n<p>The indications in the Protocol are part of a <strong>general framework of attention <\/strong>afforded to the climatic emergency with regard to the performance of work. On 19 June 2025 in fact, the <strong>Stage-Regions Conference<\/strong> had already issued <strong>guidelines<\/strong> to protect workers from the sun\u2019s heat and rays.<\/p>\n\n\n\n<p>Pending information on how the Protocol&#8217;s indications will be implemented, in <strong>message no. 2130<\/strong> of 3 July, the <strong>INPS<\/strong> provided a summary of the <strong>social shock absorbers<\/strong> that can currently be used by companies for still employed workers, also <strong>following a report by the company safety manager<\/strong> who notes the existence of risk profiles for the health of workers related to excessive heat. The following are mentioned in particular:<\/p>\n\n\n\n<p><strong>a)<\/strong> wage supplementation with the grounds \u201c<strong><em>suspension or reduction of activity by order of public authorities for causes not attributable to the company or workers<\/em><\/strong>\u201d. In this regard, it should be noted that almost all <strong>Regions<\/strong> have already issued <strong>ordinances<\/strong> prohibiting work during the hottest hours of the day for certain sectors most exposed to heat-related risk (e.g. <strong>construction and agriculture<\/strong>);<\/p>\n\n\n\n<p><strong>b)<\/strong> wage supplementation with the grounds \u201c<strong><em>weather event<\/em><\/strong>\u201d for \u201c<strong><em>high temperatures<\/em><\/strong>\u201d recognised when temperatures are higher than 35 degrees Celsius, or also lower if, in relation to the type of activity, the assessment of the so-called \u201cperceived\u201d temperature is relevant;<\/p>\n\n\n\n<p><strong>c)<\/strong> special redundancy pay for agricultural workers and employees (<strong>CISOA<\/strong>).<\/p>\n\n\n\n<p>Finally, the INPS reiterates that recourse to the social shock absorber for this kind of situation is recognised as an objectively non-avoidable event (so-called <strong>EONE<\/strong>) for which certain procedural simplifications apply. &nbsp;<\/p>\n\n\n\n<p><strong>Toffoletto De Luca Tamajo<\/strong> is at your disposal should you need any further clarification or details.<\/p>\n\n\n\n<pre class=\"wp-block-preformatted\">For further information: <a href=\"mailto:comunicazione@toffolettodeluca.it\">comunicazione@toffolettodeluca.it<\/a><\/pre>\n","protected":false},"excerpt":{"rendered":"<p>A new Protocol has been signed to address the heatwave emergency at work: it introduces prevention measures, simplified income support schemes and safeguards for employers.<\/p>\n","protected":false},"author":27,"featured_media":10030,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"content-type":"","_lmt_disableupdate":"","_lmt_disable":"","footnotes":""},"categories":[21],"tags":[89],"class_list":["post-10056","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-newsflash-insight","tag-salute-e-sicurezza-en"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.1.1 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Heatwave 2025: new guidelines on workplace safety | Toffoletto De Luca Tamajo<\/title>\n<meta name=\"description\" content=\"A new Protocol on climate-related risks in the workplace has been signed: focus on prevention, income support measures and employer liability.
