{"id":10103,"date":"2025-08-04T08:10:19","date_gmt":"2025-08-04T08:10:19","guid":{"rendered":"https:\/\/toffolettodeluca.it\/?p=10103"},"modified":"2025-08-04T09:57:14","modified_gmt":"2025-08-04T09:57:14","slug":"workers-serious-illnesses-new-protections","status":"publish","type":"post","link":"https:\/\/toffolettodeluca.it\/en\/workers-serious-illnesses-new-protections\/","title":{"rendered":"Workers with serious illnesses: new measures to safeguard health-related needs and the right to work"},"content":{"rendered":"\n<p>Law no. 106 of 18 July 2025 introduces\u00a0<strong>new support measures<\/strong>\u00a0for workers with particular\u00a0<strong>health conditions<\/strong>, with a view to guaranteeing job protection and service flexibility, thus contributing to a more equitable and inclusive world of work.<\/p>\n\n\n\n<h4 class=\"wp-block-heading has-text-color has-link-color wp-elements-7f1aefed25a3d0762d498d66ed4f8a58\" style=\"color:#e42a21\">Beneficiaries<\/h4>\n\n\n\n<p>The law refers to public and private\u00a0<strong>employees<\/strong>\u00a0suffering from\u00a0<strong>cancer<\/strong>,\u00a0<strong>disabling<\/strong>\u00a0or\u00a0<strong>chronic<\/strong>\u00a0<strong>diseases\u00a0<\/strong>(including rare ones), with a percentage of\u00a0<strong>disability<\/strong>\u00a0of 74% or higher, as well as to\u00a0<strong>self-employed workers\u00a0<\/strong>suffering from the same conditions.<\/p>\n\n\n\n<h4 class=\"wp-block-heading has-text-color has-link-color wp-elements-8c9cdee09561fc80d0014ab2de159688\" style=\"color:#e42a21\">Protection for employees<\/h4>\n\n\n\n<p>Once the periods of justified leave to which they are entitled for any reason (e.g. illness, paid and unpaid leave) have been exhausted, workers are entitled to a further&nbsp;<strong>24 months<\/strong>&nbsp;(continuous or split) of unpaid leave.&nbsp;During this period, the worker has the right to&nbsp;<strong>retain their job<\/strong>, but must not perform any other work.<strong><\/strong><\/p>\n\n\n\n<p>The leave in question does not count towards length of service or social security.<\/p>\n\n\n\n<p>However, this is without prejudice to the possibility of applying any more favourable provisions provided for in collective bargaining agreements or employment contracts.<strong><\/strong><\/p>\n\n\n\n<p>The illness must be&nbsp;<strong>certified<\/strong>&nbsp;by a general practitioner or a specialist working in an accredited healthcare facility.<strong><\/strong><\/p>\n\n\n\n<p>At the end of the leave, if the duties envisaged permit, the worker is entitled to&nbsp;<strong>priority access<\/strong>&nbsp;to&nbsp;flexible working&nbsp;as provided by Law no. 81\/2017.<strong><\/strong><\/p>\n\n\n\n<p>From&nbsp;<strong>1 January 2026<\/strong>, the right to an additional&nbsp;<strong>10 hours of paid leave per year<\/strong>&nbsp;for medical appointments, examinations, tests and other treatments will also be introduced.&nbsp;This right also applies to workers with cancer undergoing&nbsp;<strong>early follow-up<\/strong>, as well as to&nbsp;<strong>parents<\/strong>&nbsp;of minors suffering from one of the above-mentioned diseases.In the private sector, from an economic point of view, the&nbsp;<strong>allowance<\/strong>&nbsp;is advanced by the employer, who will then recuperate it by adjusting social security contributions.<\/p>\n\n\n\n<h4 class=\"wp-block-heading has-text-color has-link-color wp-elements-076a7af389fd79873f2664ff33228b96\" style=\"color:#e42a21\">Protection for self-employed workers<\/h4>\n\n\n\n<p>Self-employed workers suffering from the same diseases are entitled to&nbsp;<strong>suspend<\/strong>&nbsp;their work for a period not exceeding&nbsp;<strong>300 days per calendar year<\/strong>, instead of the 150 days currently provided for in cases of pregnancy, illness and accidents (see article 14 of Law no. 81\/2017).<\/p>\n\n\n\n<p><strong>Toffoletto De Luca Tamajo&nbsp;<\/strong>is at your disposal for any further clarification or details.&nbsp;<\/p>\n\n\n\n<pre class=\"wp-block-preformatted\">For further information: <a href=\"mailto:comunicazione@toffolettodeluca.it\">comunicazione@toffolettodeluca.it<\/a><\/pre>\n","protected":false},"excerpt":{"rendered":"<p>New protections under Law no. 106\/2025 for workers affected by serious illnesses: leave, medical time off, remote work and job retention.<\/p>\n","protected":false},"author":27,"featured_media":10088,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"content-type":"","_lmt_disableupdate":"","_lmt_disable":"","footnotes":""},"categories":[21],"tags":[401],"class_list":["post-10103","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-newsflash-insight","tag-sicurezza-sul-lavoro"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.1.1 -
