{"id":10199,"date":"2025-10-14T15:41:57","date_gmt":"2025-10-14T15:41:57","guid":{"rendered":"https:\/\/toffolettodeluca.it\/?p=10199"},"modified":"2025-10-14T15:45:30","modified_gmt":"2025-10-14T15:45:30","slug":"foreign-workers-entry-italy-decree-146-2025","status":"publish","type":"post","link":"https:\/\/toffolettodeluca.it\/en\/foreign-workers-entry-italy-decree-146-2025\/","title":{"rendered":"New rules for foreign workers entering Italy"},"content":{"rendered":"\n<p>Publication of Decree Law no. 146 of 3 October 2025, introducing a series of amendments to the Consolidated Immigration Law (Italian Legislative Decree&nbsp; 286 of July 25, 1998), with the aim of simplifying <strong>entry procedures for work purposes<\/strong>, strengthening authenticity and transparency <strong>controls<\/strong> and protecting certain categories of permits.<\/p>\n\n\n\n<p>The new measure continues and strengthens some of the measures already included in Italian Decree Law no. 145\/2024 (see our newsflash &#8220;<a href=\"https:\/\/toffolettodeluca.it\/en\/new-rules-foreign-workers-illegal-labor-fight\/\" target=\"_blank\" rel=\"noreferrer noopener\">New provisions for the entry of foreign works and the fight against the gangmaster system<\/a>&#8221; of 15 October 2024) and aims to make management of the legal entry of foreign workers more efficient and transparent.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-d1583ec5d5976b7b8de395d639e7a53d\" style=\"color:#e42a21\">Application for Work Authorisation<\/h3>\n\n\n\n<p>In line with the experimental provisions for 2025, the following have been made structural in the procedure for <strong>submitting<\/strong> applications for <strong>authorisation<\/strong> for subordinate employment, including seasonal work:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the mechanism of <strong>pre-filling applications<\/strong>: employers can pre-fill application forms on a Ministry of the Interior portal before the date set for submission (so-called &#8220;<strong>click day<\/strong>&#8220;). The pre-filled forms will then be checked for accuracy by the administrations;<\/li>\n\n\n\n<li>a <strong>maximum limit<\/strong> of <strong>3 requests <\/strong>per year for employers submitting applications as private users. This limit <strong>does not<\/strong> apply to applications submitted by union organisations or qualified professionals, who must nevertheless ensure that the number of applications is proportionate to the company&#8217;s turnover or revenue.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-86c6edaa1e7c6ed9309011a23738f049\" style=\"color:#e42a21\">Issue of work authorisation<\/h3>\n\n\n\n<p>The Decree has significant impact on the procedures for <strong>obtaining<\/strong> <strong>authorisation, <\/strong>changing the <strong>deadline<\/strong> for its issue, which now starts from the moment the request is <strong>allocated<\/strong> to the entry quota, rather than from when the application is <strong>submitted<\/strong>. In this way, timing of the procedure is linked to the actual availability of a quota, effectively lengthening the time required to process applications.<\/p>\n\n\n\n<p>Mandatory accuracy checks have also been introduced for statements by employers, host organisations and research institutes.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-a91d34bc313a16f02b1ecb7245f56510\" style=\"color:#e42a21\">Working while awaiting a permit<\/h3>\n\n\n\n<p>The right of foreign nationals to reside legally in Italy and to work <strong>temporarily<\/strong> &#8211; already provided for in cases of &#8220;waiting&#8221; for residence permits to be issued or renewed &#8211; has now also been extended to include <strong>conversion<\/strong>.<\/p>\n\n\n\n<p>This ensures greater legal certainty for both workers and businesses during long bureaucratic waiting times, ensuring full continuity of business.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-436859126e2c06d586554145f402188f\" style=\"color:#e42a21\">Permits for special cases and Inclusion Allowance<\/h3>\n\n\n\n<p>The duration of the special residence permit issued to foreigners for reasons of <strong>social protection, violence<\/strong> and <strong>labour exploitation<\/strong> is extended from six months to <strong>one year<\/strong>, and is renewable, in order to facilitate the social and professional integration of victims.<\/p>\n\n\n\n<p>In addition, holders of such permits are eligible for the <strong>Inclusion Allowance<\/strong>, as an exception to the long-term residence requirements normally required by law.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-98ec48825f23b3e9ac69c07507b525d5\" style=\"color:#e42a21\">&#8220;Out-of-quota&#8221; Entries<\/h3>\n\n\n\n<p>Foreign workers to be employed in the <strong>family <\/strong>or <strong>social-healthcare<\/strong> sector in favour of people with disabilities or the &#8220;elderly&#8221; are still classed as a type of <strong>entry over<\/strong> and above the quotas also for the years 2026, 2027 and 2028.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-9f6494c043ef8b122ea86bd937c87f13\" style=\"color:#e42a21\">Fighting modern slavery<\/h3>\n\n\n\n<p>The Decree strengthens the fight against <strong>modern slavery<\/strong> and to the <strong>labour exploitation<\/strong> by expanding the composition of the existing <strong>Operational Committee<\/strong> in the agricultural sector and the range of individuals who can access the funding from the <strong>Fund<\/strong> against the illegal recruitment of foreign labour.<\/p>\n\n\n\n<p>We await the Government&#8217;s definition of the entry flows for work for the three-year period 2026-2028.<\/p>\n\n\n\n<p>Our <strong>Global Mobility team<\/strong> is at your disposal for any support or clarification you may need.<\/p>\n\n\n\n<pre class=\"wp-block-preformatted\">For further information: <a href=\"mailto:comunicazione@toffolettodeluca.it\">comunicazione@toffolettodeluca.it<\/a><\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Italy\u2019s Decree-Law No. 146\/2025 simplifies entry procedures for foreign workers and reinforces authenticity checks and permit safeguards.<\/p>\n","protected":false},"author":27,"featured_media":10196,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"content-type":"","_lmt_disableupdate":"","_lmt_disable":"","footnotes":""},"categories":[21],"tags":[],"class_list":["post-10199","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-newsflash-insight"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.1.1 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Entry of foreign workers into Italy: new rules and simplified procedures | Toffoletto De Luca Tamajo<\/title>\n<meta name=\"description\" content=\"Decree-Law No. 146\/2025 introduces new rules on the entry of foreign workers into Italy, simplifying procedures and strengthening checks and permit protections.
