{"id":24954,"date":"2026-03-31T12:12:51","date_gmt":"2026-03-31T12:12:51","guid":{"rendered":"https:\/\/toffolettodeluca.it\/?p=24954"},"modified":"2026-03-31T12:16:36","modified_gmt":"2026-03-31T12:16:36","slug":"annual-sme-law-2026-employment-updates","status":"publish","type":"post","link":"https:\/\/toffolettodeluca.it\/en\/annual-sme-law-2026-employment-updates\/","title":{"rendered":"Annual SME Law: new developments concerning employment matters"},"content":{"rendered":"\n<p>On 23 March 2026, <strong>Law no. 34 of 11 March<\/strong>, related to small and medium-sized enterprises, also known as the Annual SME Law (<em>Legge annuale PMI<\/em>), was published. This introduces some employment-related measures aimed at <strong>encouraging<\/strong> <strong>generational change<\/strong> within small and medium-sized companies, while also <strong>clarifying <\/strong>safety obligations, with a particular focus on <strong>remote working<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-6e9729d8cf3ecb1b16d6112eeeba888c\" style=\"color:#e42a21\">Generational turnover and incentives for part-time employment contracts <\/h3>\n\n\n\n<p>The law introduces a pilot measure for <strong>2026 and 2027 <\/strong>aimed at promoting <strong>generational turnover<\/strong> in smaller companies through the <strong>implementation of part-time work for employees<\/strong> nearing pensionable age.<\/p>\n\n\n\n<p>Under this provision, private sector employees who have contributions dating back to before 1996 and who have a <strong>full-time, open-ended<\/strong> <strong>employment contract<\/strong> with a company employing up to <strong>50 employees<\/strong> and who will be eligible for old-age or early retirement by <strong>1<sup>st<\/sup> January 2028<\/strong>, can now agree to have their contract <strong>converted<\/strong> into part-time.<\/p>\n\n\n\n<p>Employees can have their normal working hours reduced from <strong>25% to 50%<\/strong>, also through elastic or flexible clauses that distribute the hours over a week or a month.<\/p>\n\n\n\n<p>Until <strong>31 December 2027<\/strong> or the date of retirement, if earlier, employees choosing to reduce their working hours in this way will be <strong>fully exempt<\/strong> from paying their share of <strong>social security contributions<\/strong>, calculated on the remuneration actually received (up to a maximum of 3,000 euros per year). Additionally, they will be eligible for a <strong>contribution integration<\/strong> up to the amount of remuneration not received as a result of the reduction in their hours. <strong>Imputed social security contributions<\/strong> will expressly be provided for during the same period, based on the remuneration corresponding to the work not performed.<\/p>\n\n\n\n<p>This benefit is subject to one essential <strong>condition<\/strong>: for each employee who reduces their working hours, the employer must <strong>simultaneously<\/strong> <strong>hire<\/strong>, with a full-time, open-ended employment contract, a <strong>person<\/strong> <strong>aged 34 or younger<\/strong>, thus promoting the entry of younger generations into the labour market. For these hires, the company can also benefit from existing incentives provided by current legislation.<\/p>\n\n\n\n<p>The measure is subject to headcount and financial limits and it is applicable to a maximum of <strong>1,000 employees<\/strong>, with management and monitoring handled by INPS.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-f3216c5b7c7f3e16d84e10689efc08fa\" style=\"color:#e42a21\">Remote working<\/h3>\n\n\n\n<p>Amendment of Legislative Decree no. 81\/2008 (<strong>Consolidated Law on Occupational Safety<\/strong>) aims to <strong>clarify<\/strong> the scope of the employer&#8217;s obligations when work is carried out in places not directly under the employer\u2019s control.<\/p>\n\n\n\n<p>Applicable to <strong>all companies<\/strong>, not just SMEs, this new provision aligns with the existing framework laid out in <strong>art. 22 of Law no. 81\/2017<\/strong>, confirming that, for <strong>remote-working activities<\/strong>, employers fulfill their obligations regarding health and safety by providing <strong>an annual<\/strong> <strong>written information sheet<\/strong> to employees and workers&#8217; safety representative.
