On 10 March 2023<\/strong>, Decree Law<\/strong> No. 20 was published in the Official Gazette, containing new rules to prevent and fight illegal immigration<\/strong> and to regulate entry flows<\/strong> for foreign workers<\/strong>.<\/p>\n\n\n\n

Entry flows<\/strong><\/strong><\/h5>\n\n\n\n

The measure provides that the entry quotas for non-EU citizens<\/strong> admitted into Italy as employees (including seasonal) and self-employed workers will be defined by a Prime Ministerial Decree which will cover the years 2023-2025<\/strong> (no longer just one year<\/strong>, as was the case until now). Should the need arise during the aforementioned three-year period, further decrees may provide for additional quotas<\/strong> against which applications already submitted by companies and not accepted will also be examined.<\/p>\n\n\n\n

To prevent illegal immigration, preferential quotas<\/strong> are envisaged for workers from States that, also in collaboration with Italy, promote mass media campaigns for their citizens detailing the risks to personal safety resulting from involvement in illegal migration<\/strong>.<\/p>\n\n\n\n

Compliance checks and asseveration<\/strong><\/strong><\/h5>\n\n\n\n

Employers will continue to be legally obliged to attach<\/strong> to the foreigner\u2019s employment application the asseveration<\/strong> issued by labour consultants and the most representative employers’ organisations (to which they adhere or which they mandate), certifying compliance with the NCBA<\/strong> (National Collective Bargaining Agreement) and adequacy<\/strong> of the number of applications submitted.<\/p>\n\n\n\n

The asseveration is not<\/strong>, on the other hand, required<\/strong> for applications submitted<\/strong> by employers’ organisations<\/strong> that have signed a special memorandum of understanding<\/strong>with the Ministry of Labour in which they undertake to ensure that their members comply with the requirements subject to the aforementioned checks.<\/p>\n\n\n\n
