{"id":6563,"date":"2023-03-23T12:54:32","date_gmt":"2023-03-23T12:54:32","guid":{"rendered":"https:\/\/toffolettodeluca.it\/?p=6563"},"modified":"2023-03-23T12:54:33","modified_gmt":"2023-03-23T12:54:33","slug":"posting-of-drivers-eu-directive-transposed-by-the-decree-published-in-the-official-gazette","status":"publish","type":"post","link":"https:\/\/toffolettodeluca.it\/en\/posting-of-drivers-eu-directive-transposed-by-the-decree-published-in-the-official-gazette\/","title":{"rendered":"Posting of drivers: EU directive transposed by the decree published in the Official Gazette"},"content":{"rendered":"\n<p>Legislative Decree No. 27 of 23 February 2023 transposing Directive 2020\/1057 on the <strong>posting of drivers in the road transport sector<\/strong> has been published in the Official Gazette.<\/p>\n\n\n\n<p>The decree, in line with the directive, states in particular, the <strong>applicability <\/strong>of the rules on <strong>posting to cabotage transport<\/strong>, while excluding its application to drivers carrying out transit operations, bilateral transport of goods or passengers.<\/p>\n\n\n\n<p>The measure, therefore, provides <strong>several obligations for employers <\/strong>posting workers to Italy as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>submission of the posting declaration at the latest at the commencement of the posting, ensuring that the declaration contains certain essential information;<\/li>\n\n\n\n<li>updating of the information in the posting declaration within 5 days of the event causing it to be updated;<\/li>\n\n\n\n<li>ensuring that drivers have the necessary documentation at their disposal (e.g. copy of posting declaration, tachograph records);<\/li>\n\n\n\n<li>transmission of posting documentation to the competent authorities no later than 8 weeks from the date of the request.<\/li>\n<\/ul>\n\n\n\n<p>In case of violation of the decree provisions, employer may incur in <strong>fines of up to 10,000 euros per violation.<\/strong><\/p>\n\n\n\n<p>In addition, the <strong>drivers<\/strong> themselves are now also subject to<strong> specific obligations<\/strong> such as, for example, the obligation to keep and, if necessary, present documentation on the posting to the traffic police.\u00a0Also in this case, <strong>infringements<\/strong> will entail the application of <strong>fines<\/strong>.<\/p>\n\n\n\n<p>Finally, the decree also amends Legislative Decree No. 144\/2008 concerning <strong>checks on the violation of working hours, driving times <\/strong>and<strong> rest periods of lorry drivers<\/strong>, increasing the frequency of the aforementioned checks.<\/p>\n\n\n\n<pre class=\"wp-block-preformatted\">Our <a href=\"https:\/\/toffolettodeluca.it\/consulenza-tax-hr\/global-mobility-expat\/\">Global Mobility<\/a> team is at your complete disposal for support or clarification. \n\nFor more information: <a href=\"mailto:mobility@toffolettodeluca.it\">mobility@toffolettodeluca.it<\/a>\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Legislative Decree No. 27 of 23 February 2023 transposing Directive 2020\/1057 on the posting of drivers in the road transport sector has been published in the Official Gazette.
