{"id":6883,"date":"2023-10-06T08:15:06","date_gmt":"2023-10-06T08:15:06","guid":{"rendered":"https:\/\/toffolettodeluca.it\/?p=6883"},"modified":"2023-11-10T16:34:06","modified_gmt":"2023-11-10T16:34:06","slug":"smart-working-extension-of-the-rights-for-the-extra-vulnerable","status":"publish","type":"post","link":"https:\/\/toffolettodeluca.it\/en\/smart-working-extension-of-the-rights-for-the-extra-vulnerable\/","title":{"rendered":"Smart working: extension of the rights for the extra-vulnerable"},"content":{"rendered":"\n<p>Smart working continues to be the subject of legislative changes.<\/p>\n\n\n\n<p>Decree Law No. 132 of 29 September 2023 has in fact extended to <strong>31 December 2023<\/strong> the right to smart working for the so-called <strong>\u201cextra-vulnerable\u201d public and private sector<\/strong> employees, namely those with serious chronic pathologies with poor clinical control and with particular connotations of seriousness (specifically identified by the <strong>Ministerial Decree of 4 February 2022<\/strong>). These individuals may request and obtain to work remotely <strong>also by being assigned to a different task<\/strong> within the same category or area of classification, without any reduction in salary.<\/p>\n\n\n\n<p>We remind you that, until <strong>31 December 2023, the right<\/strong> to smart working is <strong>also <\/strong>recognised for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>parents of children under the age of 14, provided that<\/strong> smart working is compatible with the nature of the service and that the other parent is not on benefitting from social shock absorbers or not working;<\/li>\n\n\n\n<li>workers who, based on the <strong>company doctor<\/strong>&#8216;s assessment, are at a greater risk of contagion by Covid-19 <strong>due to age or immunodepression<\/strong>, resulting from oncological diseases or ongoing life-saving therapies or, in any case,<strong> co-morbidities<\/strong>. Also in this case, the right is, however, recognised <strong>provided that <\/strong>the smart working mode is compatible with the employee\u2019s duties.<\/li>\n<\/ul>\n\n\n\n<p>Smart workers may also use, again until the end of the year, their own IT devices, if these are not provided by their employer.<\/p>\n\n\n\n<p>It is, of course, still possible to resort to smart working by drawing up <strong>individual agreements<\/strong> between the parties and recognising, in any case, <strong>priority <\/strong>to requests made by workers with particular health conditions, parents of children up to 12 years old and of the disabled or who assist family members who require care<\/p>\n\n\n\n<pre class=\"wp-block-preformatted\">For more information: <a href=\"mailto:comunicazione@toffolettodeluca.it\">comunicazione@toffolettodeluca.it<\/a><\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Decree Law No. 132 of 29 September 2023 has extended to 31 December 2023 the right to smart working for the so-called \u201cextra-vulnerable\u201d public and private sector employees.
