The 17 December deadline draws closer"},"content":{"rendered":"\n<p>As per article 24, paragraph 2 of Legislative Decree 24\/2023, from<strong> 17 December 2023<\/strong>, companies that, over the past year, have employed an <strong>average of not fewer than 50 and not more than 249 employees, with open-ended or fixed-term<\/strong> employment contracts, must activate an internal reporting channel.<\/p>\n\n\n\n<h5 class=\"gb-headline gb-headline-f94d5248 gb-headline-text\"><strong>So what should companies do in view of the 17 December deadline?<\/strong><\/h5>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Identify a suitable reporting channel with the relevant access modalities and decide whether or not to allow anonymous reports;<\/li>\n\n\n\n<li>select and appoint the people (internal and external) in charge of managing the reporting channel;<\/li>\n\n\n\n<li>draw up a procedure for managing the reporting channel;<\/li>\n\n\n\n<li>draft a document for potential whistleblowers with details about the existence of the reporting channels and how they work;<\/li>\n\n\n\n<li>assess impact on data protection;<\/li>\n\n\n\n<li>activate the internal reporting channel after consulting the company Works Council or the external unions;<\/li>\n\n\n\n<li>draw up or update the disciplinary code.<\/li>\n<\/ul>\n\n\n\n<h5 class=\"gb-headline gb-headline-e414ef33 gb-headline-text\"><strong>What to watch out for during company investigations triggered by whistleblowing.<\/strong><\/h5>\n\n\n\n<p>Internal investigations initiated by whistleblowing are a very delicate matter that must be handled appropriately.<\/p>\n\n\n\n<h4 class=\"gb-headline gb-headline-534ff7ef gb-headline-text\"><strong>Here is a list of dos and don&#8217;ts<\/strong>.<\/h4>\n\n\n\n<h5 class=\"gb-headline gb-headline-a7e817a5 gb-headline-text\"><strong>DOs<\/strong><\/h5>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Identify the most appropriate strategy and modes of operation for carrying out investigations.<\/li>\n\n\n\n<li>Hire agencies that specialise in tailing and digital forensics.<\/li>\n\n\n\n<li>Draw up the investigative mandate to any appointed agencies, complying with privacy principles and taking into account relevant case law.<\/li>\n\n\n\n<li>Conduct interviews with the whistleblower, the reported person or employees informed of the facts in the presence of witnesses.<\/li>\n\n\n\n<li>Draw up a written record of the statements made during the interviews and\/or, with the consent of the interviewee, record the interview.<\/li>\n\n\n\n<li>Carefully assess the disciplinary relevance of the elements that emerge from the investigation.<\/li>\n\n\n\n<li>Make sure disciplinary procedures and any disciplinary sanctions that may follow are handled appropriately.<\/li>\n<\/ul>\n\n\n\n<h5 class=\"gb-headline gb-headline-2dd18aa8 gb-headline-text\"><strong>DON&#8217;Ts<\/strong><\/h5>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Do not handle investigations yourself-hire experts.<\/li>\n\n\n\n<li>Do not allow unauthorised parties access to information relating to the investigations.<\/li>\n\n\n\n<li>Avoid the risk that the employee interviewed during an investigation may later claim to have been put under pressure or mistreated.<\/li>\n\n\n\n<li>Avoid indiscriminate checks on employees&#8217; company e-mails, outside the limits of the law and the rules laid down in the work tools procedure.<\/li>\n<\/ul>\n\n\n\n<p>Our firm is ready to support companies in <strong>adopting the measures required by Legislative Decree no. 24\/2023<\/strong> and in <strong>conducting company investigations<\/strong> in the best possible way.<\/p>\n\n\n\n<pre class=\"wp-block-preformatted\">For more information:<a href=\"mailto:comunicazione@toffolettodeluca.it\" target=\"_blank\" rel=\"noreferrer noopener\"> comunicazione@toffolettodeluca.it<\/a><\/pre>\n","protected":false},"excerpt":{"rendered":"<p>From 17 December 2023, companies that, over the past year, have employed an average of not fewer than 50 and not more than 249 employees, with open-ended or fixed-term employment contracts, must activate an internal reporting channel.
