{"id":7545,"date":"2024-05-15T11:19:12","date_gmt":"2024-05-15T11:19:12","guid":{"rendered":"https:\/\/toffolettodeluca.it\/?p=7545"},"modified":"2024-05-15T11:27:03","modified_gmt":"2024-05-15T11:27:03","slug":"cohesion-decree-new-incentives-for-hiring","status":"publish","type":"post","link":"https:\/\/toffolettodeluca.it\/en\/cohesion-decree-new-incentives-for-hiring\/","title":{"rendered":"Cohesion Decree: new incentives for hiring"},"content":{"rendered":"\n<p>The Government has adopted Decree Law No. 60 of 7 May 2024 (the&nbsp;<strong>so-called \u2018Cohesion Decree\u2019<\/strong>), which contains a series of incentives aimed at employment for the&nbsp;<strong>most disadvantaged<\/strong>&nbsp;in terms of age, gender, and employment status, as well as encouraging&nbsp;<strong>self-employed entrepreneurship<\/strong>&nbsp;in order to reduce territorial disparities. For each measure the decree specifies the recipients, duration, type of incentivised contract and any possible cumulability with other benefits.<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-55f54abb6fa915ed58767df1844c67b6\" style=\"color:#e42a21\"><strong>Young Entrepreneurs Bonus<\/strong><strong><\/strong><strong><\/strong><\/p>\n\n\n\n<p><strong>Unemployed persons under the age of 35<\/strong>&nbsp;who, from&nbsp;<strong>1 July 2024 to 31 December 2025<\/strong>, set up a&nbsp;<strong>business<\/strong>&nbsp;in&nbsp;<strong>sectors strategic<\/strong>&nbsp;for the development of new technologies and the&nbsp;<strong>digital and ecological transition<\/strong>, will be&nbsp;<strong>totally exempt<\/strong>&nbsp;from employers&#8217; social security contributions (excluding INAIL premiums and contributions) when they hire&nbsp;<strong>under-35-year-olds<\/strong>&nbsp;with&nbsp;<strong>open-ended<\/strong>&nbsp;<strong>contracts<\/strong>, within the same timescale.&nbsp;This relief will be capped at&nbsp;<strong>\u20ac800<\/strong>&nbsp;per month for each worker and will last for a maximum period of&nbsp;<strong>three years<\/strong>, or, in any case, until no later than 31 December 2028.<\/p>\n\n\n\n<p>At the same time, \u2018young entrepreneurs\u2019 may apply to the INPS for a&nbsp;<strong>contribution<\/strong>&nbsp;for the business set up of \u20ac500 per month, for a maximum of three years and, in any case, until no later than 31 December 2028.<\/p>\n\n\n\n<p>These measures are subject to&nbsp;<strong>authorisation<\/strong>&nbsp;by the&nbsp;<strong>European Commission<\/strong>.<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-14da6da32539a97c00edf7d6a872457a\" style=\"color:#e42a21\"><strong>Young People\u2019s Bonus<\/strong><strong><\/strong><strong><\/strong><\/p>\n\n\n\n<p>Private employers who, from&nbsp;<strong>1 September 2024 to 31 December 2025<\/strong>, hire&nbsp;<strong>under-35-year-olds with an open-ended contract<\/strong>&nbsp;who have never had a contract of this type or transform previous&nbsp;<strong>fixed-term<\/strong>&nbsp;contracts, will be&nbsp;<strong>totally exempt<\/strong>&nbsp;from their social security contributions for&nbsp;<strong>24 months<\/strong>&nbsp;(excluding INAIL premiums and contributions).&nbsp;The maximum monthly amount of the relief is&nbsp;<strong>\u20ac500<\/strong>&nbsp;for each worker, increasing to&nbsp;<strong>\u20ac650<\/strong>&nbsp;for hirings for offices or production units in Abruzzo, Molise, Campania, Basilicata, Sicily, Puglia, Calabria and Sardinia (Single Special Economic Zone for Southern Italy,&nbsp;&nbsp;the so-called&nbsp;<strong>ZES<\/strong>).<\/p>\n\n\n\n<p><strong>Recruitment of managerial staff<\/strong>&nbsp;is&nbsp;<strong>excluded<\/strong>&nbsp;from this benefit.<\/p>\n\n\n\n<p>Companies are eligible for this benefit if, in the&nbsp;<strong>six months preceding the hiring<\/strong>, they have not made any&nbsp;<strong>dismissals<\/strong>&nbsp;(individual or collective) in the same production unit for&nbsp;<strong>economic reasons<\/strong>&nbsp;and the benefit will be revoked should the employer,&nbsp;<strong>in the 6 months following the hiring<\/strong>, fire either the employee in question on&nbsp;<strong>redundancy grounds<\/strong>&nbsp;or any other employee with the same qualification employed in the same production unit.<\/p>\n\n\n\n<p>Implementation of this relief is subject to&nbsp;<strong>authorisation by the European Commission<\/strong>.<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-86090016940fb173c4e4fadda2bd5187\" style=\"color:#e42a21\"><strong>Women&#8217;s Bonus<\/strong><strong><\/strong><\/p>\n\n\n\n<p>Private employers who, from&nbsp;<strong>1 September 2024 to 31 December 2025<\/strong>, hire,&nbsp;<strong>with an&nbsp;open-ended&nbsp;contract<\/strong>,&nbsp;<strong>women of any age who have not been in regular paid employment<\/strong>&nbsp;for at least:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>24 months<\/strong>&nbsp;and are resident anywhere in Italy;<\/li>\n\n\n\n<li><strong>6 months<\/strong>&nbsp;and are resident in the regions of the Single Special Economic Zone for Southern Italy&nbsp;(ZES);<\/li>\n\n\n\n<li><strong>6 months<\/strong>, if hired in a profession or economic sector characterised by a marked gender employment gap<strong>;<\/strong><\/li>\n<\/ul>\n\n\n\n<p>will be&nbsp;<strong>totally exempt<\/strong>&nbsp;from their social security contributions for 24 months (excluding INAIL premiums and contributions).&nbsp;The monthly amount of relief is capped at&nbsp;<strong>\u20ac650<\/strong>&nbsp;for each female worker.<\/p>\n\n\n\n<p>The incentive is granted on condition that there is a net&nbsp;<strong>increase in the number of employees<\/strong>, calculated on the difference between the number of workers employed each month and the average number of workers employed in the previous 12 months.<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-9dd4ac4d73fc1c8b9ccb5a47e847595e\" style=\"color:#e42a21\"><strong>ZES Bonus<\/strong><strong><\/strong><strong><\/strong><\/p>\n\n\n\n<p>Private employers with up to&nbsp;<strong>10 employees<\/strong>&nbsp;who, from&nbsp;<strong>1 September 2024 to 31 December 2025<\/strong>, hire, with&nbsp;<strong>open-ended contracts<\/strong>, in an office or production unit in the&nbsp;<strong>Special Economic Zone (ZES<\/strong>)&nbsp;<strong>over-35-year-olds<\/strong>&nbsp;who have been unemployed for&nbsp;<strong>at least 24 months<\/strong>, are eligible for a&nbsp;<strong>24-month<\/strong>&nbsp;<strong>total exemption from payment<\/strong>&nbsp;of their social security contributions (excluding INAIL premiums and contributions).&nbsp;The monthly amount of the relief is capped at&nbsp;<strong>\u20ac650<\/strong>&nbsp;for each worker.<\/p>\n\n\n\n<p>Recruitment of managerial staff is&nbsp;<strong>excluded<\/strong>&nbsp;from this class=\"has-text-color has-link-color wp-elements-59a7858cc4d980357c5a48494f3e508c\" style=\"color:#e42a21\">****<\/p>\n\n\n\n<p>The incentives detailed in the new Decree do&nbsp;<strong>not<\/strong>&nbsp;apply to&nbsp;<strong>domestic employment<\/strong>&nbsp;or&nbsp;<strong>apprenticeships<\/strong>,&nbsp;<strong>cannot be accumulated<\/strong>&nbsp;with other exemptions or reductions in force,&nbsp;<strong>but are compatible<\/strong>, without any reduction, with the increase in the cost of labour allowed as a deduction in the presence of new hirings, introduced by the recent Legislative Decree No. 216\/2023 (the so-called&nbsp;<strong>maxi-deduction<\/strong>).<\/p>\n\n\n\n<p>It should be noted that, as specified by law, application of the exemptions in question&nbsp;<strong>does not affect future pensions<\/strong>, and the rate used to calculate pension benefits remains unchanged.<\/p>\n\n\n\n<p>Definition of how the exemptions will be implemented is referred to the adoption of&nbsp;<strong>subsequent ministerial decrees<\/strong>.&nbsp;In any case, the incentives will be limited by the&nbsp;<strong>spending totals<\/strong>&nbsp;established for each, and constant monitoring by the INPS will mean that no further applications will be accepted if the set thresholds are detected, even prospectively, as being reached.<\/p>\n\n\n\n<p>The general principles for benefitting from these incentives set forth in Article 31 of Legislative Decree 150\/2015 remain unchanged, including, in particular, the requirement
