{"id":7851,"date":"2024-10-02T07:21:43","date_gmt":"2024-10-02T07:21:43","guid":{"rendered":"https:\/\/toffolettodeluca.it\/?p=7851"},"modified":"2024-10-02T07:21:44","modified_gmt":"2024-10-02T07:21:44","slug":"protecting-workers-from-reprotoxic-substances","status":"publish","type":"post","link":"https:\/\/toffolettodeluca.it\/en\/protecting-workers-from-reprotoxic-substances\/","title":{"rendered":"Towards a Safe and Sustainable Working Environment: New Decree on Protecting Workers from Reprotoxic Substances"},"content":{"rendered":"\n<p>On 26 September 2024, Legislative Decree No. 135 of 4 September 2024 was published, implementing&nbsp;<strong>Directive (EU) 2022\/431<\/strong>&nbsp;<strong>on the protection of workers<\/strong>&nbsp;from the risks arising from exposure to carcinogens, mutagens, and reproductive toxicants in the workplace.<\/p>\n\n\n\n<p>The aim of this decree is to&nbsp;<strong>expand the definition<\/strong>&nbsp;of hazardous agents to include, in addition to carcinogens and mutagens,&nbsp;<strong>substances toxic to reproduction<\/strong>. Protecting workers is a key priority to prevent potential health damage and to ensure the well-being of both those directly affected and future generations.<\/p>\n\n\n\n<p>Specifically, the decree introduces amendments to the&nbsp;<strong>Consolidated Law on health and safety at work<\/strong>&nbsp;(Legislative Decree No. 81\/2008), with a focus on:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Distinguishing between\u00a0<strong>\u201cnon-threshold\u201d\u00a0<\/strong>reproductive toxic substances, for which no permissible limit is set, and\u00a0<strong>\u201cthreshold\u201d\u00a0<\/strong>substances, for which new\u00a0<strong>occupational exposure limit values<\/strong>\u00a0are introduced (i.e., the concentration levels of the agent in the air in the workplace);<\/li>\n\n\n\n<li>Introducing\u00a0<strong>biological limit values<\/strong>\u00a0(i.e., the levels of agent absorption in the worker&#8217;s body measurable through exhaled air, urine, or blood tests), currently provided only for chemical agents (lead and diisocyanates), also for carcinogens and mutagens, given their recognized toxicity during reproductive age;<\/li>\n\n\n\n<li>Imposing specific\u00a0<strong>obligations on employers<\/strong>, such as avoiding or reducing the use of these substances, updating\u00a0<strong>risk assessments<\/strong>, regularly\u00a0<strong>informing and training<\/strong>\u00a0exposed workers, and subjecting them to\u00a0<strong>health surveillance<\/strong>.
