Public Contracts Code: bonus points only for companies with Equality Certification

With Decree Law no. 57 of 29 May 2023, the Government has made the first corrections to the new Public Contracts Code regarding bonus criteria and gender equality.

The previous text ruled that in the calls for tenders, notices and invitations, contracting stations should award a higher score to companies that certified, also through a self-certification, that they had the necessary requirements to obtain the Equality Certification. It was then up to the contracting station to verify the soundness of the successful tenderer’s self-certification by any means (see our article “Public Contracts: bonus points for companies that ensure gender equality” of 08.05.2023).

Whereas now, the awarding of the bonus scores in question is expressly conditional on the proven possession of Gender Equality Certification by the employers.

Please note that the new Public Contracts Code has been in force since 1 April 2023 but it will become applicable on 1 July.
